Peervyce Copyright and IP Complaint Policy (DMCA)
DRAFT TEMPLATE — NOT LEGAL ADVICE. This document was written as a starting point for Peervyce and has not been reviewed by a lawyer. Replace every bracketed placeholder (for example [ENTITY NAME] and [ADDRESS]) and have a lawyer licensed in Massachusetts review it before you rely on it or publish it as final.
Effective date: [EFFECTIVE DATE]
[ENTITY NAME] ("Peervyce") respects intellectual property rights and expects users to do the same. We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512, and to trademark complaints as described below.
1. Designated agent
Copyright notices should go to our designated agent:
Morris Toglan
[ENTITY NAME]
[ADDRESS]
Email: support@peervyce.com
(Operator note: the agent must also be registered with the U.S. Copyright Office's DMCA Designated Agent Directory, and the registration renewed every three years, for safe-harbor protection. Delete this note before publishing.)
2. Copyright infringement notice
Your notice must be in writing and include:
- Your physical or electronic signature (or that of a person authorised to act for the copyright owner).
- Identification of the copyrighted work claimed to be infringed (or a representative list if there are several).
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example, the URL on peervyce.com, the Program name, or the creative).
- Your contact information: name, address, telephone number, and email.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
Knowingly making a material misrepresentation in a notice may make you liable for damages under 17 U.S.C. § 512(f).
3. What we do
When we receive a valid notice, we will remove or disable access to the material promptly, notify the user who posted it, and give them a copy of the notice.
Material that sits on an Affiliate's or Merchant's own website (not on peervyce.com) is outside our control. We will forward your notice to the account holder and may pause their links or Program while the matter is resolved, but you should also contact the site's host.
4. Counter-notice
If you believe your material was removed by mistake or misidentification, send our agent a counter-notice that includes:
- Your physical or electronic signature.
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district in which Peervyce may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We will forward the counter-notice to the complainant. Unless they tell us they have filed a court action seeking to restrain the activity, we may restore the material 10 to 14 business days after receiving the counter-notice.
5. Repeat infringers
We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
6. Trademark and other IP complaints
If you believe a Merchant, Affiliate, Program, creative, or ad on the Platform misuses your trademark (for example, trademark bidding, counterfeit goods, or confusing impersonation), email support@peervyce.com with: your name and contact details; the mark and its registration number(s) and jurisdiction(s), if registered; the specific material and where it is; and an explanation of the confusion or misuse, with a statement that the information is accurate and that you are the owner or authorised to act for them. We will review, may ask both sides for information, and may remove material or suspend accounts. We are not able to decide legal disputes between third parties.
